Terms of Service
Draft, October 21, 2026. To be reviewed by counsel before launch. These terms are an agreement between you and Incline DMA LLC (“My Pitlist”, “we”), an Arizona company, for the My Pitlist website and the My Pitlist and My Pitlist Crew apps.
1. What My Pitlist is
My Pitlist is a marketplace. Artists, managers, promoters, venues and brands (“Clients”) find and book photographers, videographers, VJs, lighting designers, laser technicians, drone pilots, content creators, editors and audio engineers (“Creators”). Each booking is a contract between the Client and the Creator. My Pitlist is not a party to it, does not employ Creators, and does not guarantee any work, beyond processing payments and running the dispute process described below.
2. Accounts
You must be 18 or older. Each person uses their own login. A Client account (for an artist or company) can have several members; every member can see that account’s gigs, bookings and payment history. Saved payment methods belong to the person who added them and are never shared with other members. You are responsible for activity on your login.
3. Fees
Creators pay a service fee on each payment they receive: 15% standard; 10% for the first 100 Creator profiles (“Founding Creators”) for as long as the profile stays active; and 10% on each Creator’s first 5 paid bookings. Tips are not subject to a fee unless shown otherwise at the time of the tip. Fees in effect when a booking is created apply to that booking. Clients pay the agreed price. We may change fees for future bookings with notice.
4. Payments
Payments are processed by Stripe. Creators must complete Stripe’s onboarding to be paid and agree to the Stripe Connected Account Agreement. Clients pay a deposit (currently 20%) to confirm a booking; the payment method used is saved to that person’s login and charged for the balance as described below. All payments for work found on My Pitlist must go through Pitlist. Arranging payment outside My Pitlist for a booking that started here is not allowed and can lead to account removal.
5. Deposits and cancellations
The deposit is paid to the Creator when the booking is confirmed. If the Client cancels more than the booking’s cancellation window (currently 7 days) before the first date, the deposit is refunded. If the Client cancels within that window, the Creator keeps the deposit. If the Creator cancels, the Client receives a full refund of the deposit.
6. Content jobs: delivery, balance and revisions
Each content booking has a delivery deadline. When the Creator delivers on or before the deadline, the balance is charged to the saved payment method and the final files unlock for the Client. The Client may request the number of revisions included in the booking during the revision window chosen for that booking (3, 5 or 7 days). The Creator’s payout of the balance is held until the revision window closes and any requested revision is delivered. If delivery is late, the Client may approve and pay, request a revision, or do nothing; with no response for 3 days the delivery is approved and charged.
7. Live jobs
Live jobs (such as lighting, lasers and VJ) have no deliverables or revisions. The balance is charged the day after the last show date. The Client may report a no-show or a problem until 24 hours after the show. Without a report, the Creator is paid out 48 hours after the show.
8. Disputes
A Client may open a dispute if a Creator does not respond to a revision request within 2 days, does not deliver, does not show up to a live job, or the work is not what was agreed, within the windows above. Open disputes pause the payout. My Pitlist reviews the booking record, messages and files and may refund the Client in full or in part, or release the payment to the Creator. Our decision on the funds we hold is final within My Pitlist; it does not limit any legal rights you have against the other party.
9. Usage rights
Unless the booking says otherwise: once paid in full, the Client and their team may use the delivered work to promote the artist (social media, press, website, tour and marketing materials), crediting the Creator where practical. The Creator keeps copyright and may show the work in their portfolio. Paid advertising, merchandise and resale need separate written permission.
10. Conduct
No harassment, discrimination, fake profiles, misleading listings, spam, or content you don’t have rights to. Contact details are hidden in messages until a deposit is paid. You can report and block other users. We may remove content or accounts that break these terms.
11. Disclaimers and liability
My Pitlist is provided “as is”. We do not verify every claim users make about themselves or their work. To the extent the law allows, My Pitlist’s total liability for any claim is limited to the fees My Pitlist received for the booking involved, and My Pitlist is not liable for indirect or consequential damages.
12. Ending your account
You can delete your account in the app at any time once you have no bookings in progress. Records needed for payments, taxes and disputes are kept as required by law.
13. Law
Arizona law governs these terms. Disputes with My Pitlist are handled in Maricopa County, Arizona courts.
